Bellamy Brothers Flash Mobbed by Thousands in Europe!

Last week while media blitzing Europe in support of their new release with German pop star D.J. Ötzi, country music’s legendary duo, the Bellamy Brothers, made history when they were simultaneously flash mobbed in three separate cities in Germany, Switzerland and Austria.

European fans and dance clubs organized the massive flash mob, set to the tune of the new Bellamy, Ötzi tune, “Like A Star.” The flash mob was heavily promoted internationally throughout Europe via Facebook and Twitter.

The end result was thousands upon thousands of Bellamy Brothers and D.J. Ötzi fans (all stationed in public locations in Berlin, Zurich and Vienna), boot scootin’ in perfect sequence to the new hit song featured on the recently released, D.J. Ötzi & the Bellamy Brothers: Simply The Best (Universal Music Germany).

“We were in Berlin rehearsing for a television performance when we heard about the mob,” says David Bellamy. “We drove over and were in complete awe of how many people were singing and dancing to ‘Like A Star’ in perfect sequence.”

Howard Bellamy notes, “The coolest part of the flash mob was that it was happening not only where we were in Berlin but also in Switzerland and Austria at the exact same time. We were told we set some sort of world record but we’re still waiting on specifics.”

Bellamy Brothers Dedicate Weekend Norway Performance to Victims of Bombing, Shooting

Yesterday, July 30, country music’s multi-platinum selling Bellamy Brothers performed in Lyngdal, Norway in memoriam of victims of the country’s recent massacre.

Tragedy struck Norway last Friday with the devastating loss of over 70 innocent lives from a mass shooting and bombing.

Howard and David Bellamy, who are traveling to Norway this week, were asked to dedicate their weekend Rosfjord Strand Hotel performance to those who lost their lives in the senseless attacks.

“We’ve been playing concerts in Norway since 1976 and have cultivated many friendships and have fond memories from touring there over the years,” says David Bellamy. “The nightmare they encountered this past week is almost unimaginable. I think the closest think we can relate it to is September 11.”

“When we perform in Lyngdal, Norway this Saturday night, we’d like them to know our thoughts and prayers go out to each and every person in their great country,” notes Howard Bellamy. “We are dedicating the show to the victims and the families and we hope the healing process can soon begin for everyone. God bless Norway and peace and love from the Bellamy Brothers.”

Bellamy Brothers Vow to Aid New Zealand Earthquake Victims

In the midst of the Japanese earthquake and tsunami coverage, most of the attention has been deferred from the February 22nd earthquake in New Zealand. And while the devastation in Japan weighs heavy on the hearts and minds of the world, the second-largest city in New Zealand is left in ruins with many lives lost and others left without homes. The 6.3 magnitude tremor was the second major earthquake to hit the city of Christchurch, New Zealand in five months.

Country music’s brotherly duo the Bellamy Brothers have teamed with the New Zealand Red Cross and Judy Seale International to raise support for earthquake victims through donations for a live auction, to be held from May 1st through May 10th on www.trademe.co.nz . A smaller auction will be held on eBay. All proceeds go to the New Zealand Red Cross. Any contribution, large or small, will help accommodate quake victims.

“We are excited to help get the word out about the celebrity auction for the Christchurch, New Zealand earthquake victims,” says David Bellamy. “Our hearts also go out to the folks in Japan and we hope to assemble a similar benefit for them in the very near future.”

The Bellamy Brothers Release Statement In Response to Brittany Spear’s Song Rip-off

Attorney Christopher E. Schmidt, legal representation to country music’s the Bellamy Brothers, released the following statement in response to pending legal action against pop star Britney Spears:

The Bellamy Brothers have been artists, in the true sense of the word, with over 50 hit songs; more than 20 of those songs reaching the No. 1 position in the country charts over the past 35 years. The music business has given them the rare opportunity to enjoy making a living writing and playing music all over the world. Even though David and Howard are some of the nicest and most down to earth guys you will ever meet, they are also smart and experienced businessmen. So naturally, David asked me for my legal opinion of whether or not the Britney Spears recent single “Hold It Against Me” infringed on the copyright of their song “If I said You Had A Beautiful Body Would You Hold It Against Me” that David wrote in 1979.

In my opinion, it is not necessarily the similarity of the titles that is of legal concern. This would be more of a trademark issue. Rather, the issue is whether or not the exact lyrics “would you hold it against me” are used in the same way in the hook of the song. It becomes somewhat uncanny if you simply double the beat of the Bellamy Brothers’ song and match it up with Britney’s version. Literally thousands of fans for both artists have also taken notice. They are scratching their heads questioning whether or not Britney’s song “lifted” part of the song previously written by David Bellamy. But for me, the scale tips substantially in knowing that Dr. Luke not only co-produced Britney’s song with Max Martin, but that Dr. Luke also co-wrote the song with Max Martin and others. This isn’t the first time Max Martin and Dr. Luke have been accused of copyright infringement.

Dr. Luke was sued in 2007 for copyright infringement along with Avril Lavigne and her record label for “lifting” portions of Avril’s hit song “Girlfriend.” The suit subsequently settled in 2008. There is also a current Katy Perry song that features Snoop Dogg called “California Gurls” produced and co-written by Dr. Luke and Max Martin (among other writers, including Katy Perry) where The Beach Boys’ record label has filed a diminutive claim against the writers and publishers of the song for credit and royalties. Dr. Luke was party to yet another copyright infringement suit in 2008 for the song “Feels Like Tonight” by Daughtry. Although this is not conclusive evidence that Dr. Luke intentionally lifted a phrase from a Bellamy Brothers song, it certainly shows a possible pattern and warrants a more serious look into the matter.

As a transactional attorney primarily focusing on managing my clients’ careers and protecting their intellectual property, I had a duty to bring in the heavyweights to help us further evaluate the situation. I put a call in to Daniel Moskowitz who is a friend and colleague with the Nashville law firm King & Ballow. Daniel had mentioned to me before that one of the partners in the litigation section of his firm, Richard Busch, had won a multi-million dollar suit against Universal/Aftermath Records for Eminem. Richard also received a jury award of over four million dollars for his clients against Bad Boy Records. Most importantly, I recalled Daniel telling me that Richard recently established new precedence regarding copyright infringement in the United States Court of Appeals for the Sixth Circuit when the court affirmed a ruling that copyright infringement may occur by the copying of a single common word such as “Dog,” if the alleged infringer uses that word in the new composition in the same way as it was used in the original musical composition.

This past week, the Bellamy Brothers and I met with Richard Busch to engage his services and handle this matter appropriately. Richard has submitted the two songs to a renowned musicologist for evaluation and expert opinion. From here, it is just a matter of trying to work things out amicably with everyone involved.

Bellamy Bros. Now Considering Legal Action Regarding New Britney Spears Release

 

After releasing a Tuesday statement directed at popstar Britney Spears, the Bellamy Brothers have the media buzzing worldwide. Most are asking the question, “Will we see a lawsuit?” It’s possible. Earlier yesterday, the brothers’ Nashville publicist confirmed the group has indeed decided to “weigh their legal options.” The country music duo is claiming Spears ‘ripped off’ their 1979 hit, “If I Said You Had A Beautiful Body, Would You Hold It Against Me” with her new single, “Hold It Against Me.”

In the time since the Bellamys released their public statement, the media coverage has poured in from all around the world. TMZ was the first to provide coverage, posting both songs and asking viewers to vote ‘yes’ or ‘no’ in a poll titled, ‘Britney’s song – rip off?’ Celebrity news blogger Perez Hilton titled his post on the topic, “Is Britney’s ‘Hold It Against Me’ a rip-off?” Tuesday, in talking with Entertainment Weekly, David Bellamy, still a bit surprised by the happenings, admitted, “It’s not every day that you get into the middle of a brawl with Britney Spears.” On Spears’ new single, “Hold It Against Me,” Bellamy reaffirmed his stance with the Boston Herald by stating, “When I did listen to her song, I thought ‘Well this is rather unoriginal.’”

Yahoo! News Music blogger Chris Willman made an interesting deduction when he noted that “Hold It Against Me” writers Dr. Luke and Max Martin seem to have a past history of snagging similar song titles of yesteryear for new music, specifically Katy Perry’s “California Gurls” and “I Kissed A Girl.” Willman writes, “There does seem to be a bit of a pattern emerging in the Dr. Luke/Max Martin camp, where everything old is new again, when it comes to appropriating familiar old titles or lyrical hooks. Dr. Luke has said in interviews that he’s not that much of a lyric guy, so it seems entirely likely that Katy Perry was responsible for borrowing those earlier titles—and that Britney had this one pop into her head, after almost certain exposure to it growing up in the South.”
