The now closed Toby Keith‘s I Love This Bar and Grill must pay Destiny USA $10.5 million after breaching its contract, a judge has ruled. Toby Keith’s abandoned its third floor location in the middle of the night last May. And it appears to have walked away from the lawsuit, too.
State Supreme Court Justice Hugh Gilbert decided in favor of the mall after Toby Keith’s missed a November deadline to contest the lawsuit. Destiny’s lawyer declined to comment when asked what chance the mall has in collecting its debt. Right now, the $10.5 million judgment is simply a piece of paper sitting in the clerk’s office.
It’s not clear what Toby Keith’s next move will be. But there’s no sign that the parent company, Boomtown Entertainment, of Arizona, followed through with its threat to sue the mall back in local court. A company spokesman had accused Destiny of violating the lease terms by allowing another mall venue — notably Jimmy Buffet’s Margaritaville — to offer live music.
